Just as other types of insurance protect your person and your property from unforeseen occurrences, title insurance protects your title to real estate and guards against any losses that might occur during the sale and throughout the ownership of the property.

There are two basic types of policies: An owners policy to protect the owner, and a loan policy to protect the banks mortgage.

Your title search

The first benefit you receive upon ordering title insurance  is the title search. Some of the things a title search uncovers are any unpaid taxes or mortgages, judgments against previous owners, easements, and other court actions or recorded documents that can affect title to real estate. We evaluate such defects and work with you to make the necessary corrections so that these matters are cleared up and any concerns are eliminated before the closing. Beyond the initial search, your title insurance also covers against any issues that could not be found out in a title search, as well as any errors made in the search itself.

Your Protection

When a bank requires a loan policy, it protects their interests only. You may still be liable for title problems even though the bank is insured. Only an owners policy of title insurance protects you, the homeowner. Basic coverage insures:

  • That you are the owner of the property
  • That you have a legal right of access to the property
  • Against losses from any liens or encumbrances on the property except those listed in the policy
  • Against your title being rejected by a later buyer because it is unmarketable due to a title defect or lien

 Your insurance also covers any costs related to defending the title in court, and the cost of settling the claim if it proves valid, in order to perfect your title and keep you in possession of your property.

You are covered under the policy for as long as you own the property, and also for liability after you sell the property, as long as you provide title covenants in your deed to the new buyer.

Cost

Unlike other forms of insurance, the original premium is your only cost as long as you own the property. There are no annual payments to keep your owners policy in effect.
